Parents Have a Right to Representation in DCPP Cases
Having a child brings a great amount of joy and responsibility into a parent’s life. Carrying out these responsibilities can be a challenge, and every parent makes mistakes along the way. In cases where the state believes that a parent may be putting their child’s health or safety at risk, the New Jersey Division of Child Protection and Permanency (DCPP) may intervene.
Both federal and New Jersey state laws offer protections for the rights of parents to raise their children. Whether the DCPP wishes to bar the parent from visiting with their child and make the other parent the sole custodian, or remove the child from parental custody and place them in the care of the state or a foster parent, the parent being accused of dangerous behavior has a right legal representation.
Our Englewood parental rights attorneys can work to find a custody or visitation solution that will best provide for you and your child’s interests.
Proving a Child’s Paternity in New Jersey
Before a parent can exercise their rights to visit with their child and make decisions about their upbringing, they may need to prove that they are, in fact, their child’s biological parent.
Likewise, a mother may need the court’s help in establishing a father’s identity to receive the child support payments they need and deserve to help raise the child. Not all parents are eager to allow access to the child for the necessary testing to establish parentage, nor are all potential fathers willing to undergo these tests. Parents may need a lawyer’s help when proving paternity – help our Englewood parental rights attorneys can provide.
Father’s Rights in New Jersey
Frequently, fathers fear that they’ll face unfair treatment from the court during parental rights cases.
Under New Jersey Code, mothers do not technically have different rights than fathers when it comes to family law issues such as child custody or support.
For example, either parent can have primary custody of a child in New Jersey. Additionally, either parent may find themself paying for child support. Statistics reporting that mothers may be more likely to receive support or custodial status often state such figures in light of the fact that mothers occupy the status of “stay at home parent” more often. As of 2013, the U.S. Census reported that only one out of every six custodial parents in the U.S. were fathers.
However, recent family studies indicate a dramatic uptick in the number of stay-at-home fathers among households. As such, fathers are more likely than ever to file for custody and support during family law disputes.
At Herbert & Weiss, LLP, our Englewood parental rights attorneys are committed to helping parents across New Jersey protect their rights and pursue an outcome that enables their children to thrive.
